Terms of Service

1. Acceptance of Terms

By accessing or using JustAsk.Lawyer ("Platform", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

2. Description of Service

JustAsk.Lawyer is an online platform that connects individuals seeking legal services ("Clients") with licensed attorneys ("Attorneys"). We facilitate the scheduling and payment of legal consultations but do not provide legal advice or services directly.

2.1 No Attorney-Client Relationship with Platform

JustAsk.Lawyer is not a law firm and does not provide legal advice. No attorney-client relationship is formed between you and JustAsk.Lawyer. Any attorney-client relationship is solely between Clients and Attorneys.

3. User Eligibility

3.1 General Requirements

• You must be at least 18 years old to use this Service
• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account

3.2 Attorney Requirements

Attorneys using the Platform must:

• Be licensed to practice law in at least one U.S. jurisdiction
• Maintain current malpractice insurance
• Be in good standing with all applicable bar associations
• Provide accurate information about their credentials and practice areas
• Comply with all applicable rules of professional conduct

4. Booking and Consultation Process

4.1 Consultation Scheduling

Clients may book consultations with available Attorneys through the Platform. All consultations are subject to Attorney availability and confirmation.

4.2 Payment Terms

• Payment is required at the time of booking
• Consultation fees are set by individual Attorneys
• JustAsk.Lawyer charges a platform service fee of 20% of the consultation fee
• All payments are processed securely through our payment processor

4.3 Cancellation Policy

• Client Cancellations: Clients may cancel up to 24 hours before the scheduled consultation for a full refund. Cancellations made less than 24 hours in advance are non-refundable.
• Attorney Cancellations: If an Attorney cancels, Clients receive a full refund and may rebook with another Attorney.
• No-Shows: Failure to appear for a scheduled consultation results in forfeiture of the consultation fee.

5. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Impersonate any person or entity or falsely state your affiliation
• Interfere with or disrupt the Service or servers
• Upload viruses or malicious code
• Collect or harvest information about other users
• Harass, abuse, or harm other users
• Share confidential information obtained through the Platform inappropriately

6. Professional Conduct (Attorneys)

Attorneys agree to:

• Maintain client confidentiality in accordance with professional rules
• Avoid conflicts of interest
• Provide competent representation
• Communicate clearly about the scope of services
• Comply with all applicable professional responsibility rules
• Not guarantee specific outcomes or results

7. Disclaimers

7.1 No Legal Advice from Platform

JUSTASK.LAWYER DOES NOT PROVIDE LEGAL ADVICE. Information on our Platform is for general informational purposes only and should not be construed as legal advice.

7.2 No Guarantee of Results

We do not guarantee any specific legal outcomes or results from consultations booked through our Platform.

7.3 Independent Contractors

Attorneys are independent contractors and not employees, agents, or partners of JustAsk.Lawyer. We are not responsible for the quality, accuracy, or outcomes of legal services provided by Attorneys.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUSTASK.LAWYER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO JUSTASK.LAWYER IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

9. Indemnification

You agree to indemnify and hold harmless JustAsk.Lawyer, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

10. Privacy and Data Protection

Your use of our Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

10.1 Attorney-Client Privilege

Communications between Attorneys and Clients through the Platform may be protected by attorney-client privilege. JustAsk.Lawyer will not access these communications except as required by law or to provide the Service.

10.2 No Privilege for Initial Searches, Inquiries, and Reviews

IMPORTANT NOTICE: The following activities are NOT protected by attorney-client privilege:

• Searches conducted in the "Find Your Attorney" feature
• Initial messages sent to attorneys before a formal consultation is booked
• The "Brief Description of Your Legal Issue" submitted during booking
• Attorney profile views and browsing history
• Pre-consultation inquiry forms or messages
• Reviews, ratings, and feedback about attorneys
• Responses to reviews posted by attorneys

Attorney-client privilege only begins when you have formally engaged an attorney for a consultation or representation. All pre-engagement communications, booking information, and all post-service reviews may be visible to platform administrators for quality assurance and safety purposes.

10.3 Booking Information - No Privilege

CRITICAL NOTICE: The "Brief Description of Your Legal Issue" field in booking forms is NOT protected by attorney-client privilege under any circumstances. By submitting this information, you acknowledge that:

• This description is stored in our database and is NOT confidential
• Platform administrators can and do review these descriptions
• This information could be disclosed in case of a data breach
• This information may be subject to legal process or subpoena
• NO attorney-client privilege attaches to this description, even after consultation
• This field should NEVER contain sensitive, confidential, or detailed information

SECURITY WARNING: Treat this field as completely non-confidential. Only include the most general description (e.g., "divorce matter," "business dispute," "traffic ticket"). Save all sensitive details for your actual consultation. JustAsk.Lawyer is not liable for any consequences arising from information you choose to include in this field.

10.4 Public Nature of Reviews

By submitting a review, you acknowledge that:

• Reviews and ratings are publicly visible to anyone visiting the website, including non-registered users
• Your review contributes to the attorney's public rating displayed on their profile
• You should not include confidential case details in reviews
• Attorneys may publicly respond to reviews
• Reviews cannot be anonymous and will display your first name and last initial
• Reviews and ratings cannot be edited or deleted once submitted, except by platform administrators
• JustAsk.Lawyer reserves the right to moderate or remove reviews that violate our guidelines

WARNING: Because reviews are visible to the general public and search engines may index them, never include sensitive information, case specifics, or anything you wouldn't want publicly associated with your name.

11. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of JustAsk.Lawyer or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

12. Dispute Resolution

12.1 Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

12.2 Class Action Waiver

You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

13. Governing Law

These Terms shall be governed by the laws of the State of Maryland, without regard to its conflict of law provisions.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

15. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
